How To Write A Contract For Selling A Car

 

Some cases, trading in a car at a dealership is cheaper than Sell Your Car Brisbane. With the higher dollar amount, comes the responsibility of creating your own contract. A Bill of Sale, or auto sales contract is an easy document to draft on your own. Many states provide a template for a Bill of Sale that you can print from their Department of Motor Vehicles website.


 

Write Your Own Contract

The contract should clearly identify the buyer and seller as well as the purpose of the agreement. The first sentence should include the legal names of the buyer and seller, and that the contract is a sale contract. This is a contract between Joe Smith and Dan Jones for the sale Joe Smith's 1995 Honda Civic sedan.
  • Include the addresses of both the buyer and seller.
  • For identification and verification, you may also wish to include the driver's license numbers of the buyer and seller.

Please provide a detailed description of your vehicle. Use as many characteristics as you can to identify the vehicle. [1] If the contract only specifies the year and model of the car, such as "1990 Toyota Camry", and the owner owns two 1990 Toyota Camrys it will be difficult to determine which car is meant. Include as many details as you can:
  • Color
  • Year
  • Make a model
  • Body type (pickup, SUV, 4 door sedan)
  • Interior color
  • Other unique features (including cosmetic and mechanical problems)
  • Vehicle Identification Numbers (VINs)
  • Odometer reading
Be sure the information you receive is accurate. A contract can be voided if the seller makes false claims about the vehicle or the terms of sale. Make sure all parties are on the same page and that there is no misrepresentation of the vehicle or funds to be exchanged. 
  • The contract could be voided if, for example, the owner of the vehicle states that it has 167,000 miles, but he knows that in fact the car has 200,000 and has a defective odometer.
  • In the contract, you should state if the odometer was ever repaired or replaced. Use the boilerplate language "I certify that I have owned the vehicle for a period of time during which the odometer has been altered to repair or replace the odometer, and the mileage recorded on the repaired or new odometer is identical to the original."
